On June 8, 2026 Antoine’s original trial judge struck his two 1st Degree murder convictions to 2nd Degree murder, citing Frederickson, 1016 Cal App 910, Penal Code 1172.1. The preceding will continue in months to come to consider if Penal Code 1172.6 will apply.
The judge said that in the 30 years that she has been on the bench, this was one of the hardest decisions she has had to make because of everyone impacted in the case. She said, “The most compelling testimony was from the former principal of CSP-SOL, and 2 Correctional Officers from San Mateo County jail” where Antoine has been housed since 2023.
Joseph Bell, Drop LWOP, Associate Coordinator said, “I am soooooo proud of our Drop LWOP Coalition Organizers for showing up via Zoom, along with Silicon Debug and other supporters. I believe all of this advocacy made a difference. The DA tried to undermine our support as “just advocates that don’t have to consider the victims family””.

Yesterday felt like a miracle! Thank you for your support through all of these proceedings. Every bit of community and family support helped the defense achieve a successful outcome for Antoine. He has been in custody at the Maguire Jail regarding this matter since May 19, 2023. Here is a timeline:
1997: Mr. Crecy was arrested and has been in custody ever since.
1999: He was convicted of two counts of first-degree murder with special circumstances.
2000: Judge Barbara Mallach sentenced him to life without parole (LWOP).
2020: His Petition for Resentencing Pursuant to Penal Code Section 1170.95 was denied by Judge Barbara Mallach.
2023: He was moved to SMCO Jail for these proceedings.
2024: Judge Mallach denied our motion under PC1172.6. (This is under appeal.)
2026: Judge Mallach reduced both counts from first-degree murder with specials to second-degree murder, converting Antoine’s sentence from LWOP to 15 years to life on each count. He now has a chance at Parole. His sentencing hearing is set for July 29, 2026 at 9:00 a.m.
And last but not least, Peter Goldscheider, Antoine’s long-time attorney in many proceedings concerning this matter, was a rock star!
I have worked for the San Mateo County Private Defender Program since 2002, and have never met a client who exemplifies ‘rehabilitation’ to the extent that Mr. Crecy does, not only in his rhetoric but also in his heart. The reality is that Mr. Crecy has logged over 650 hours as a certified group facilitator at Solano Prison. When you factor in the years of intensive participant and trainee hours required just to earn that leadership role, he has dedicated well over 1,500 hours to institutional healing—becoming a producer of rehabilitation for hundreds of other men. That was in addition to working full time in prison and earning 57 credits toward an AA degree. When he cried after hearing the Judge’s decision yesterday, he was grateful for the ruling but felt great sadness, knowing it would bring more pain to the victims’ families. If that doesn’t speak to a man’s maturity, empathy, and rehabilitation, then I don’t know what does.
